Privacy policy

This policy explains in plain words what happens to your personal data when you use this site. It is governed by Ecuador's personal data protection law (Ley Orgánica de Protección de Datos Personales) and its regulations. The Spanish version is the original.

Who is responsible for your data

The controller is Manta Ocean Homes, run by the host, Ashraf. For anything about your data, write to reservations@mantaoceanhomes.com or on WhatsApp to +593 96 832 6943.

What data is handled and why

This site has no user accounts, takes no payment and does not keep on its servers what you type into the booking form.

When you send a request, what you typed (your name, the house, the dates, the number of guests and your message) passes from your phone or computer straight to WhatsApp or to your email program. Only when you send that message does the host receive it.

Two parts of the form ask the site's server something, without your name or your message: the calendar asks for the taken nights of the house you chose and, if you type a discount code, the code, the house, the dates and the number of guests are sent to work out the discount. None of that is stored.

The host uses that information, and anything you give him afterwards, to:

  • Answer your enquiry, confirm availability and price, and manage your booking and your stay.
  • Keep the guest register required by tourism regulations: the name of the person booking, the length of the stay, the number of adults and of minors, and a contact phone number.
  • Issue the sales receipt. If you ask for an invoice in your name, you will be asked for your identification number and address.
  • Deal with complaints and meet legal obligations.

Technical data about your visit

Like any web server, the one that hosts this site records for a limited time the IP address, date and browser type of each visit, for security and operation. This site uses no tracking or advertising cookies. Details are in the Cookie policy.

On what legal basis

  • Your consent, which you give by ticking the box on the form and sending the message, and which you can withdraw at any time.
  • The steps before a lodging contract that you ask for, and then the performance of that contract.
  • Compliance with legal obligations, in particular tax and tourist-lodging rules.

Who it is shared with

Your data is not sold or passed on for advertising. These third parties are involved, each under its own privacy policy:

  • WhatsApp, owned by Meta, if you choose to write that way.
  • Email providers, yours and the host's, if you choose email.
  • The provider that hosts this website.
  • YouTube, only if you play a video, and Google Maps, only if you open the map.
  • The tax and tourism authorities, when the law requires information to be given to them.

Transfers outside Ecuador

Several of those providers keep information on servers outside Ecuador. When you use them, your data may be processed in other countries, with the safeguards each provider states in its policy.

How long it is kept

  • The guest register, six months, as tourism regulations state.
  • Sales receipts and their supporting records, for as long as tax law requires.
  • Enquiries that do not become a booking are deleted when they are no longer needed and, at the latest, after one year.

Your rights

At any time you may ask for access to your data, for it to be corrected and updated, deleted, for its processing to be suspended, and for it to be handed to you in a portable form; and you may object to processing or withdraw your consent. No automated decisions are made about you.

To exercise these rights, write to reservations@mantaoceanhomes.com with your name and what you are asking for. You will be answered free of charge within the period the law sets. If you believe your right has not been respected, you may complain to Ecuador's data protection authority, the Superintendencia de Protección de Datos Personales.

Minors

Bookings are made by people aged 18 or over. For minors who stay, only their number is recorded.

Security

The site is served over an encrypted connection (HTTPS). The site does not receive or store card or bank account details.

Changes to this policy

If this policy changes, the new version is published on this page with its date. If the change affects how data you have already given is used, you will be told.
